Santa Clara County Small Claims Court cases are heard in three different locations in Santa Clara County: Palo Alto, Downtown Superior Court, and Morgan Hill.

Santa Clara County Small Claims Court Advisor

Downtown Superior Courthouse

The Downtown Superior Courthouse hears Santa Clara County Small Claims Court cases and is located at:

The Downtown Superior Courthouse is the correct venue if the Defendant resides in the following areas: Campbell, Los Gatos, Milpitas, Monte Sereno, San Jose, Santa Clara, or Saratoga.  This is also the proper venue if the case involves a contract entered into or performed in any of the above areas or concerning damage or injury in any of the above cities.

South County Morgan Hill Courthouse

The South County Morgan Hill Courthouse hears Santa Clara County Small Claims Court cases and is located at:

The South County Courthouse is the correct venue if the Defendant resides in the following areas: Gilroy, Morgan Hill, or San Martin.  This is also the proper venue if the case involves a contract entered into or performed in any of the above areas or concerning damage or injury in any of the above cities.

Palo Alto Courthouse

The Palo Alto Courthouse hears Santa Clara County Small Claims court cases and is located at:

The Palo Alto Courthouse is the correct venue if the Defendant resides in the following areas: Cupertino, Los Altos, Los Altos Hills, Mountain View, Palo Alto, or Sunnyvale.  This is also the proper venue if the case involves a contract entered into or performed in any of the above areas or concerning damage or injury in any of the above cities.

Santa Clara County Courthouse

Santa Clara County Small Claims Court offers night court sessions in the Santa Clara Courthouse at 6:00PM on the second and fourth Tuesday of every month (excluding court holidays).  This courthouse is only available for night court sessions.

Note: If the plaintiff files three or more actions against the same defendant at the same time, the actions have to be filed in the Downtown Superior Courthouse pursuant to Santa Clara County Local Civil Rule 18(A)(1).
